Ohio public schools are required to provide appropriate levels of education to the students living within their district. How that education is delivered, virtual or in person, does not change the districts liability. The COVID pandemic has forever changed the landscape of general liability insurance. While most insurance policies have always contained language limiting insurance coverage for pollutants and contaminants, discussions on specific exclusions for the spread of communicable diseases has become the norm. State leaders are asking districts to develop plans to educate kids as normal as possible in the face of an unknown virus while district leaders are being educated on the potential lack of insurance coverage should those plans harm students or staff. How exactly are we supposed to operate in the face of the new normal? This presentation will review current exclusionary language in all insurance forms, detail specific cleaning and disinfecting processes to slow the spread of communicable diseases and how to make your district as defensive as possible should claims arise.
